This Agreement shall apply to MilitaryCafe.org (also “the site”, “the sites”, the “Network”). Your rights and obligations under this Agreement and in using this Site are not assignable. Your use and access of the Network constitutes your acceptance, without modification, of the terms, conditions and notices contained herein as well as those posted on this site. In addition, you shall be subject to any posted guidelines, rules, and policies applicable to such services that may be posted from time to time. All such guidelines, rules, and policies are hereby incorporated by reference into this Agreement.
By using the Network, you acknowledge that you have read this agreement and that you accept the terms thereof. If you do not agree to the terms and conditions of this Agreement, you may not access, view, obtain goods or services from, or otherwise use any of the features within.
Acknowledgments
* You acknowledge that upon becoming a member, you are automatically subscribed to receive periodic notifications from us (militarycafe.org) regarding your membership, new feature updates or other information that might be useful to you.
* You acknowledge that you are 18 years of age or older. Under no circumstances may a minor post ads in our personal or classified sections of the site or conduct any business requiring a credit card purchase.
* You agree to the terms and conditions of our Privacy Policy, incorporated by reference herein.
* You acknowledge that MilitaryCafe.org reserves the right, at its sole discretion, to change, modify, add, remove or terminate any portion of this Agreement, in whole or in part, at any time, without prior notice.
* You acknowledge that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this Agreement and will not cause injury to any person or entity; and that you hereby indemnify MilitaryCafe.org or its affiliates for all claims resulting from content you supply.
* You acknowledge that you will not post misleading or duplicate personal or classified ads. You will not use discussion boards to post products or services for sale or post spam links. You will not post phone number(s) or addresses, credit debit cards, calling card, user account numbers/ passwords or similar financial information, and home phone numbers or addresses.
* By posting messages, creating or modifying personal or business web sites, chatting, uploading files, inputting data, transmitting e-mail, or engaging in any other form of communication (hereinafter “Communications”) through MilitaryCafe.org, you hereby grant to MilitaryCafe.org a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free license to use, copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise exploit such Communications throughout the world, in all media now known or hereafter developed. You hereby waive all rights to any claim against MilitaryCafe.org for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with such Communications.
Registration Required
In order to utilize our products, all visitors are asked to become registered members. As such you will be asked to provide certain personal information, including, but not limited to Name, user name, e-mail address, basic location. This information is used solely for internal purposes. Your personal information is protected at all times and is never sold to any third party.
* Registered users of this social networking web site are permitted to submit classified styled advertisements of a personal or business nature; search our jobs database, access our information areas.
Limited License
Registered users of any of the above named sites are hereby granted a non-exclusive, non-transferable, limited license to use our programs. The contents, and every part thereof, of MilitaryCafe.org are only for your personal use. You do not acquire ownership rights to any content, document, or other materials viewed through our site. The posting of information or materials on MilitaryCafe.org does not constitute a waiver of any right in such information and materials.
Restrictions
You may not copy, sell, redistribute, license, sublicense or otherwise give any of programs belonging to MilitaryCafe.org to any third party. Additionally, you may not give away or trade your registration user name/password with any other person or party. You may not alter or subvert any programming in any way. Our personal and business web site programs are required to remain on our servers at all times. Neither of these kinds of sites, once leased by a registered user, may be moved to servers outside of this network. Only the text and graphics personally uploaded to the user-created sites may be removed by the registered user of the site.
Forbidden Web Sites/Uses
The Network reserves the right to refuse or discontinue service to any user that violates our license policy or restrictions or engages in the following forbidden activities:
(a) posts material that violates local, state, federal or international laws;
(b) posts any material that violates or infringes in any way the rights, including copyrights, trademark rights or other intellectual property rights of any third party;
(c) posts hate propaganda;
(d) posts fraudulent material or fraudulent activity;

(g) uses any software, information, or other material that contains a virus, corrupted data or engages in any action that corrupts our programming;
(h) uses any software or information to promote or utilize software or any of our services to deliver unsolicited e-mail.
(i) posts any material that promotes pornography or contains pornographic material (as determined by us).

Sale of Forbidden Products
Members engaging in the sale of goods within the Network are required to know the law. The following items are generally restricted to some extent by the laws of the U.S. Federal Agencies such as FDA, BATF or Customs Dept.: food, alcoholic beverages, firearms, cigarettes or other tobacco products, pharmaceuticals or any other controlled substance, dangerous, counterfeit or stolen goods or goods from embargoed countries. You are solely responsible if you engage in any illegal activities.
Suspensions/Terminations
The Network may immediately, without prior notice, issue a warning, temporarily suspend, indefinitely suspend, or terminate your use of and access to the Site, at our sole discretion, for any reason, whether with or without cause or warning, and without liability. Your sole remedy against the Network in the event of a dispute arising out of this Agreement, the Site or your use thereof, is to terminate this Agreement by ceasing your use of the Site. In the event of termination of this Agreement, the Network may delete or store, in its discretion, data associated with your use of the Site. We may also change, suspend, or discontinue any aspect of the Web site at any time, including the availability of any Web site feature, database, or content.
Disclaimers
The Network makes no warranty, express or implied, with respect to the content, information, or services provided through, or in conjunction with the Web sites. We make no guarantee of the accuracy, correctness or completeness of any information on the Site, and shall not be responsible for: (i) any errors of omission arising from the use of such information; (ii) any failures, delays or interruptions in the delivery of any content or service contained within the Network; and (iii) any defamatory, libelous or unlawful material contained within the Site, including user Web pages/sites, resumés, emails, profiles, opinions, advice, statements, memorandums or discussion board postings, or other materials related to a users’ use of the Site. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk.
The Network is not involved in any transaction between any parties who use our Site. The Web site is a venue only and we do not screen, censor, or otherwise control the Personal ads, the Classifieds or other listings made by members. The shops listed in the PX are operated by third parties who maintain their own privacy policies. Privacy Policy
We gather two types of information about users: 1) Data that users provide through voluntary registration and 2) aggregated tracking information derived mainly by tallying page views throughout our sites. When you register for one of our program, you will be asked to provide certain information: Name, City, State/Province, Zip, Country, E-mail Address, Branch of Service, Certain other demographic information. You shall defend or settle at your sole expense any claim or suit, including without limitation any proceeding, investigation or claim by a self-regulatory organization, state or federal securities agency or commission, (any “Action”) against the Network and/or each of its affiliates, directors, officers, agents, employees or sublicensees to the fullest extent permitted by law arising out of or in connection with (a) an assertion that the information, content or other materials or services provided or made available by you or the use thereof may infringe any copyright or trademark rights of any individual or entity, or are a misappropriation of any individual or entity’s trade secret, or contain any libelous, defamatory, disparaging, pornographic, or obscene materials; (b) any breach by you of your obligations under this Agreement; and (c) any content provided by you in an advertisement, message board, e-mail, or home page (created or used by you) on the Network, or statements made by you in the Site or through other media. You shall indemnify and hold harmless the Network from and against any and all damages, costs, liabilities and attorneys’ fees incurred in defending and/or resolving such Action.
